ANGELO STATE UNIVERSITY STUDENT BODY CONSTITUTION

 

We, the members of the Angelo State University Student Body, united in our desire to ensure effective and persuasive representation, achieve higher academic standards and performance, and to foster an environment of tolerance, inclusion and equal opportunity for all students do hereby adopt this constitution for the Angelo State University Student Body.


ARTICLE I -MEMBERSHIP

Section 1. Every enrolled student, so defined by the regulations of Angelo State University, shall be a member of the Student Body and shall have an equal voice and vote therein with one's fellow students. Every student shall be subject to this Constitution, its by-laws and the laws of the Student Body.

Section 2. The governing organization of the Student Body of Angelo State University shall be known as the Student Government Association of Angelo State University. The Student Government Association shall be recognized as the representative of the Student Body and as such its actions, not limited herein, supersede those of all other student organizations.

ARTICLE II -THE LEGISLATURE

Section 1. All legislative powers herein granted shall be vested in legislative body of the Angelo State University Student Government Association, to be known as the Student Senate.

Section 2. The Senate shall be composed of members chosen by the Angelo State University Student Body, for a term of one year; and each Senator shall have one vote.

Senators shall be apportioned among the several colleges according to their respective numbers. The Senate shall have the power to apportion the electorates by appropriate legislation.

The Angelo State University Student Body President shall nominate, and by and with the advice and consent of a majority of the Senate, shall appoint 5 freshman Senators, one from each electorate for a term of one year; and each Senator shall have one vote.

No person shall be a Senator who has not completed a minimum of twelve semester hours in residence and is not enrolled in and does not maintain a minimum of twelve semester hours with a cumulative grade point average of 2.0 or who is a graduate student and is not enrolled in and does not maintain a minimum of nine semester hours with a minimum cumulative grade point average of3.0, unless said Senator is graduating at the end of the current semester or participating in a student teaching program; and who is not a member of the college the Senator intends to represent.

No person shall be a Freshman Senator who is not enrolled in and maintains a minimum of twelve semester hours with a cumulative grade point average of2.0.

The Vice President of the Angelo State University Student Body shall serve as the President of the Senate, but shall have no vote unless the Senate is evenly divided.

The Senate shall elect officers, as Student Senate may deem necessary, for the proper functioning of Student Senate, and also a President pro tempore to preside over the Senate in the absence of the Vice President.

In the event that a member of the Angelo State University Student Government Association is no longer able and/or willing to uphold his or her oath of office, the Senate shall have the sole power to impeach and try all impeachments. When the President of the Angelo State University Student body is tried, the Chair of the Judicial Council shall preside over the trial; and no person shall be convicted without the pronouncement of two thirds of the Senate.

Section 3. When a vacancy exists, the Angelo State University Student Body President shall nominate, and by and with the advice and consent of a majority of the Senate, shall appoint Senators to fill any such vacancy.

Section 4. The Senate shall determine it’s rules and procedures, compel the attendance of members, censure a member by a two thirds vote of the Senate, and fix the time and place of its meetings provided that the Senate meet at least once every two weeks.

Section 5. Every piece of legislation, having acquired the approval of a majority of the Senate, shall be presented to the President of the Angelo State University Student Body. If the Angelo State University Student Body President approves of the legislation it shall be signed, but if not signed, the Angelo State University Student Body President shall return the legislation to the Senate where it shall be reconsidered within ten days. If after such reconsideration two thirds of the Senate votes in favor of the legislation it shall be adopted.

Section 6. The Senate shall exercise authority to provide for the control and disbursement of all Student Government Association funds and shall appropriate funds for a period not to exceed one year.

Section 7. The Senate, by two-thirds vote, shall have the authority to seek the approval of the Angelo State University Student Body, of any legislation at the polls, by referendum, and shall approve for appearance at the polls, by two-thirds vote; the wording of said referendums initiated by the Senate.

Section 8. The Senate shall acquire a quorum of no less than one-half of the current membership of Senators to conduct business.

Section 9. No member of the Senate shall concurrently hold offices within two or more branches of the Angelo State University Student Government Association, unless specifically directed by the Angelo State University Student Body Constitution.

ARTICLE III -THE EXECUTIVE

Section 1. The executive power of the Angelo State University Student Government Association shall be vested in the Angelo State University Student Body President, assisted by the Student Body Vice President, and such administrative officers as the Student Body President shall appoint in accordance with the established laws.

Section 2. The Angelo State University Student Body President and Vice President shall be chosen by the members of the Angelo State University Student Body, for a term of one year.

Section 3. No person shall serve as Angelo State University Student Body President who has not completed a minimum of twelve semester hours in residence and is not enrolled in and maintains a minimum of twelve semester hours with a cumulative grade point average of2.0 or who is a graduate student enrolled in a minimum of nine semester hours with a minimum cumulative grade point average of3.0, unless the President is graduating at the end of the current semester or participating in a student teaching program.

Section 4. The Angelo State University Student Body President shall nominate, and by and with the advice and consent of a majority of the Senate, shall appoint, the officers of the Executive Cabinet who shall be responsible to the Angelo State University Student Body President for the execution of their duties and shall be subject to removal from office by the Angelo State University Student Body President. The officers of the Executive Cabinet shall be established by law.

Section 5. The-Angelo State University Student Body President shall nominate, and by and with the advice and consent of a majority of the Senate, shall appoint members of the Judicial Council, and all other officers of the Angelo State University Student Government Association whose appointments are not herein otherwise provided for, and which shall be established by law.

Section 6. The Angelo State University Student Body President shall have the power to approve or veto bills and resolutions passed by the Senate except those bills and resolutions dealing with purely internal affairs of the Senate; this is limited to approvals of appointments, resolutions of impeachment, and standing rules.

Section 7. The Angelo State University Student Body President shall have the authority to seek the approval of the Angelo State University Student Body, of any measure at the polls, by referendum, and shall approve for appearance at the polls the wording of said referendums initiated by the Angelo State University Student Body President,

Section 8. No member of the executive branch shall concurrently hold offices within two or more branches of the Angelo State University Student Government Association, unless specifically directed by the Angelo State University Student Body Constitution. .

ARTICLE IV -THE JUDICIARY

Section 1. The judicial power of the Angelo State University Student Government Association shall be vested in the Judicial Council and in such inferior councils as the Senate may from time to time ordain and establish.

Section 2. The Judicial Council shall be comprised of 5 Councilors, one of the Councilors shall be a freshman, to serve for a term of one year, and each shall have one vote in the affairs of the Council.

Inferior councils shall be comprised of a number of Councilors to be determined by appropriate law.

No person shall be a Councilor who has not completed a minimum of twelve semester hours and is not enrolled in a minimum of twelve semester hours with a cumulative grade point average of 2.0 or who is a graduate student enrolled in a minimum of nine semester hours with a minimum cumulative grade point average of 3.0.

The Angelo State University Student Body President shall nominate, and by and with the advice and consent of a majority of the Senate, shall appoint a Chief Councilor to be the head of the Judicial Council.

Section 3. The Judicial Council shall have the authority to hear and decide by majority decision all cases arising under this Constitution or the laws of the Angelo State University Student Government Association.

Section 4. No member of the judicial branch shall concurrently hold offices within two or more branches of the Angelo State University Student Government Association, unless specifically directed by the Angelo State University Student Body Constitution.

ARTICLE V -AMENDMENTS

The Senate, whenever two thirds of that body shall deem it necessary, shall propose amendments to this constitution, or, on the petition often percent of the Angelo State University Student Body, shall place before the Angelo State University Student Body said amendments. Said amendments shall be valid as part of this Constitution only after ratification by two thirds of those members of Angelo State University Student Body going to the polls.

ARTICLE VI -REFERENDUMS

Section 1. The members of the Angelo State University Student Body shall have the authority to propose and directly enact measures at the polls by the power of referendum.

Section 2. A petition to have a measure approved at the polls shall contain the full text of the measure proposed, and to be valid, shall be signed by five percent of the Angelo State University Student Body. Upon receipt of said petition by the Angelo State University Student Body President, the referendum shall appear at the polls for the concurrence of the Angelo State University Student Body. Laws may be enacted to govern the acquisition and validation of signatures on said petition.

Section 3. Approval of any and all referendums shall require the concurrence of a majority of those members of the Angelo State University Student Body going to the polls.
